I've spoken to apple and am sending it back to them tomorrow, hopefully they replace it again? my only concern is that on the Apple Product replacement request email they State: "Accessory HW Issues - Physical Damage - Cosmetic - scratched". This isnt my fault?!? im calling them now to clarify

I'm on the same boat with you. I'd happily go out and exchange it for a new one, but I'm afraid the next one will be the same or even worse - and if I wait it out to see if Apple is going to do anything about it, that they'll say it's physical damage (if the cracks get bigger) and put the fault on me.
I don't understand how other iPhone owners aren't experiencing this, I'm pretty sure if you tried looking really carefully under a strong light, you'll see tiny fractures (they look almost like scratches, but they're not because you can see that it alters the way the light reflects off the surface) near the volume rockers and the headjacks.
