i dont think you can do anything about the plan, phone repayments maybe, but as you said you paid up front.
Maybe they will make a good will gesture, fingers crossed

Of course you can do something about this. You haven't received the product for which you've signed a contract to pay. Take it up with Optus, and if that fails, contact the TIO. As a consumer, you have rights.
What I would have done (and what I planned to do if there were massive delays on receiving my iPhone) was wait a couple of weeks after signing the contract, and if still no phone, contact Optus and tell them to postpone payments 'til I have the thing physically in my hand.
Now that it's been a month and you've received your bill, things might be a bit messier to deal with, but I'm quite sure Optus will help you out here, you just need to speak up about it.

Errr... its been a couple of weeks.... for everyone.
My suggestion is you sit tight until you get the phone. Despite so many on these boards thinking that companies are some sort of malicious being, they are just made up of people like you and me who can apply common sense, and are closely controlled by regulators, public opinion and brand concerns. They will not rip you off, but you have to be patient and confident of your position.
Oh and a patient and friendly approach with your issues is always far more effective than being agitated and forceful.

Too early in the morning for me. Assumed first bill = one month, and perception of time went out the window. O_O
Okay, so let me get this straight. Your 'first bill' is JUST your handset repayments (in one lump sum) and your warranty payments, correct? Not sure why they didn't just give you a bill at the end of the month with everything included. Is this what they said they would do?
If this is the case, then you probably could just pay it. However, I still stand by what I said. Since you haven't received what you were promised yet, you can take it further if you choose to. It isn't really fair to pay anything for something you haven't yet received.

I called the TIO who gave me a case number and then I called Optus Complaints with that case number.
I have been able to cancel my contract and they are waiving the early termination fees due to the delay.
I just ported my number away from Optus last night to Vodafone, as I was able to pick up a Black 16gb from Myer Melbourne.
Myer Melbourne have heaps in stock, but only on Vodafone.
It didnt worry me really, as I will make heaps more calls then what I would use data, so the $99 plan with Vodafone gives $600 worth of calls on a lower rate per 30 seconds than what Optus offers and 500mb of downloads.

adamjc: Cool, that's good if you didn't mind actually cancelling your contract. In your case, it worked in your favour. Not so sure the OP wants to cancel, though. lol.
Still don't get why he got a bill after only 2 weeks though. They're putting all the handset repayments (since I chose to pay a lump sum) on my first month's bill. I just assumed it would be the same for everyone else on Optus.

Good move, adam. I would have done that had I been screwed around by Optus too long. WiFi hotspots for me are marginal value at best (I have wifi at home and work anyway) and that's the only real advantage Optus had over Voda except for a little more data and a slightly less per month spend.

This raincheck is going to get optus into problems. It seems highly dubious making you pay for something you don't know when you will get.
I was told by an Allphones store that I would have a white16GB phone almost certainly the next day and guaranteed by Monday.
I phoned Optus and they said resellers shouldn't put unrealistic expectations of delivery and the person I spoke to acknowledged that some resellers are falsely promising quick deliveries just to sign people up.
I have been told by Two differant Optus people over the phone that there is a 10 day cooling off period for rainchecks.
I am going into Allphones on Monday and either picking up my iphone or cancelling. I phoned the manager today after optus had rang him too and he said fine either a white iphone or you can cancel-which I will do as I am prepared to wait.

It really comes down to me not having to call Optus anymore and dealing with staff that are sick of the iPhone in general.
When Optus Customer Care told me the phone wouldn't arrive until early September, that was the last straw for me. They were only too accommodating to waive the fees for me, and I only have to pay for the 2 weeks I used the service. So probably around $30.
In the end I am just happy to forget about it and play with my new phone! Coverage between Voda and Optus seems to be very similar.

Hi,
because you signed the contract, I dont think you can do anything. as previously mentioned, try to dispute the handset repayments..

You can get out of the contract without paying any early termination fees if you have not received your phone.
I did just that on Friday by getting a Case number from the TIO then calling Optus Customer Complaints. They have waived all early termination fees for me now.

I got a bill from Optus before the handset. Complained and they told me they'd reissue the bill under my old plan. They are well aware how upset people are.

Why are some people getting Optus bills before the first month? Is it under some special circumstances like moving from an old plan to a new one, or something similar?
