iPhone SMS competition - illegal?

G'day,

I just saw an ad on the tv by one of those rip-off SMS companies, where they are using an iPhone to lure people into a $4 per message "competition"...

My thought was - given that the iPhone hasn't passed Au telecommunications specs, wouldn't this be illegal?

Further, are they selling it "broken" or "as is"?

Hahaha interesting indeed. I happened to see the same competition this morning and thought it was odd that they were advertising it as part of some competition...

Well whether it be legal or not i guess we'll see if it still gets air'd

It's been on Austar for quite a while, I'm so sick of ads like this.
Yeah I'd like to see how there going to offer that 'prize'.

I'm curious what the situation would be for someone roaming in australia with a non certified phone, I doubt that its illegal, I'm sure someone knows where the line is drawn

Yeah, I asked the question about iPhone usage legality a few weeks ago...

Maybe someone should drop a line to Telstra or someone

I HATE those SMS rip offs... phishing for idiots... (no offence to anyone who finds them... useful? or has been suckered in...)

It is illegal under that Telecommunications Act so if its made public then yeah, you will get into trouble but the police arent going to arrest someone because they see someone using an iPhone walking down the street.

(I guess given that I... possibly... maybe... used my TAM's geoport modem... which was never cleared in Australia... I should be a bit more accommodating... :} but if I can't have an iPhone, dammit, no one should! *mwahahar!*)
