So how are they going to tell that somebody is illegally swapping files, without inspecting the contents of the data stream? Presumably Japan has some kind of privacy laws. Not to mention the technical cost involved.

The sooner that the loose coalition of content publishers (movie studios, record companies, et al.) stop using the word stealing, the sooner they will get the general population on side. Most people instinctively know that stealing is when you deprive someone else of their property, and that copying is inherently not stealing. It follows then that much of their message (that illegal copying is wrong), is missed because of the language they use.

Deep packet inspection has been available in CISCO gear for a while and a lot of the ISP's would have it. But it can be circumvented by encryption.
I know of a few UNI's that use it in Australia.

And why can't I purchase TV shows at the same time they're released in the US?
I subscribe to eMusic. It means that I basically don't obtain that music through *cough* unofficial sources because it's cheap, simple, of a guaranteed quality and DRM-free. If industry wants to see how to stop piracy, they need look no further.

I agree... but in many circumstances, it is a means to the same end.
So, that person didn't rob a bank... they counterfeited money and then went to a shop and used that counterfeited money to buy a $5000 TV... The retailer discovers the money is counterfeit after the fact and has to notify the police... therefore, they are short one TV and $5000.
Someone goes out and buys a DVD for $25, copies it and redistributes it on BitTorrent to 10,000 people. So now, the film distributor is short $250,000.
I'm sick of the excuse: "music/video should be cheaper, so I just download it free instead". Yeah, milk should be cheaper than it is too... but I don't go hide out at the farm and milk a couple of cows while no-one's looking. The cows can make more milk, why should the farmer care?

This analogy only works if you can prove all 10,000 people would have actually purchased the item and were willing to pay money for it in the first place.
